A man has been acquitted of a rape charge by the Suva High court.
It was alleged that the accused Mitieli Kacikaci had carnal knowledge with a woman without her consent at Nasinu on the 29th of May in 2014.
Suva High Court Judge Justice Vincent Perera stated after carefully considering the complainant’s evidence and the evidence given by the accused, he is not convinced that the complainant’s evidence was credible and reliable.
He said there is a serious doubt as to whether or not she consented to have sexual intercourse with the accused.
Therefore, Perera stated the complainants evidence does not establish the offence of rape beyond reasonable doubt.
The Judge concurred with the unanimous opinion of the assessors and found the man not guilty of rape.
